Pre-compliance and compliance
Pega Smart Dispute™ Agent Automation facilitates the alternate possibilities in Visa dispute processing under certain circumstances.
Pre-compliance and compliance
Issuers or Acquirers can choose to file pre-compliance. Depending on the pre-compliance response, Issuers or Acquirers can choose to file a compliance
Issuing bank dispute operators can initiate pre-compliance when the merchant or Acquirer violates Visa rules under the following conditions:
- There is no dispute, dispute response, or pre-arbitration right.
- There is a financial loss due to the violation.
If the Acquirer fails to respond to the pre-compliance request within a specified timeframe of 30 days, the Acquirer is deemed fully liable. In this scenario, the dispute is resolved, and the Acquirer is held liable by considering the pre-compliance response as Accept Full.
If the Issuer submits a pre-compliance and the Acquirer declines the pre-compliance, the application allows Issuing bank disputes operator to initiate compliance.
The compliance request goes to Visa for acknowledgement and once Visa reviews the compliance and provides an acknowledgment if the details are correct and then provides the final ruling deciding the liable party between the Acquirer and Issuer.
The liable party, be it the Issuer or the Acquirer, can initiate an appeal if they are not satisfied with the ruling and the dispute amount is at least USD 5,000. The ruling provided on appeal is considered final.
Good faith
The good faith processing option is available when the timeline of the specified transaction has expired. You can use good faith processing to proceed with appropriate resolution options at the dispute level.
Recall and withdraw
Recall and withdraw options are available when the cardholder no longer wishes to pursue the dispute or if the cardholder has filed the dispute in error. The party which has raised the pre-arbitration or arbitration cases can recall and withdraw the cases and don't have to be resolved any further. These options are available throughout the dispute lifecycle whenever the party that has initiated the dispute is awaiting action from the other party.
